Where it applies

Written for the jurisdictions listed here.

North Carolina charges the in-state tuition rate to several groups who would otherwise pay the nonresident rate. At a University of North Carolina system institution the gap between the two is large enough that this is often worth more per year than any cash benefit in this catalog. An active duty service member (on active duty for more than 30 days) whose permanent duty station is in North Carolina pays in-state rates, and so do their dependants, under G.S. 116-143.3. If the member is reassigned outside North Carolina or retires, the in-state rate continues for a student who stays continuously enrolled, so a mid-degree permanent change of station does not blow up the cost of finishing; after an honorable discharge it continues if the member or dependant establishes North Carolina residency within 30 days and stays enrolled. A dependant child enrolled in a North Carolina high school when a parent is reassigned out of state keeps the rate by enrolling the next fall and staying enrolled. Every member of the North Carolina National Guard is charged in-state tuition regardless of where they live, which reaches Guard members living in a neighboring state: G.S. 116-143.1(h1) covers "Any member of a North Carolina National Guard unit who is a nonresident", in reserve or active duty status. A veteran using VA education benefits qualifies for in-state rates while living in North Carolina, however long ago the discharge was. The rule is federal: under 38 U.S.C. 3679(c), a public institution must charge the in-state rate to a covered individual using chapter 30, 31, 33 or 35 benefits who lives in the state while enrolled, whatever the formal state of residence, and from August 1, 2026 also to anyone using the Montgomery GI Bill Selected Reserve under 10 U.S.C. chapter 1606 (Public Law 119-55). Covered individuals include a veteran discharged after at least 90 days of active service and a spouse or child using transferred Post-9/11 or Fry Scholarship entitlement. The three-year limit after discharge that older guidance, including earlier versions of this entry, describes was struck by Public Law 116-315, section 1005, for terms beginning on or after August 1, 2021. A veteran told they are too long out of service to get the in-state rate while using the GI Bill should cite the federal section. North Carolina National Guard members should also look at the state tuition assistance program, which reimburses tuition for associate, bachelor, and graduate degrees as well as certificates and vocational training, for drilling members, subject to fund availability and a two-year service obligation after the money is received. Its application windows are narrow and fixed by term, so missing one costs a semester. None of this involves a disability rating.

Expands benefits Removed the three-year window after discharge from the rule that public schools charge covered veterans in-state tuition.

Struck "less than three years before the date of enrollment in the course concerned" from 38 U.S.C. 3679(c)(2)(A), for terms beginning on or after August 1, 2021. A veteran with ninety days of active service using a covered VA education benefit and living in the state must be charged the resident rate at a public institution however long ago the discharge was. State guides and at least one catalog entry still described the old window.
