Nebraska In-State Tuition for Veterans and Their Families

Resident tuition at any Nebraska public college from the first day, for a veteran with ninety days of service and for a family member using transferred benefits. The condition is registering to vote in Nebraska.

Also called: 85-502.01, in-state tuition, resident student, ninety days, voter registration, transferred entitlement, Chapter 31, Chapter 35, Fry Scholarship.

For: Veteran or service member, spouse, child.

Where it applies

Written for the jurisdictions listed here.

Section 85-502.01 treats a veteran and several categories of family member as a resident student for tuition purposes from the moment they enrol, notwithstanding the ordinary Nebraska residency rules in 85-502. Given the gap between resident and non-resident tuition at the University of Nebraska, this is worth more per year than most of the entries in this file. Who it covers. A veteran as defined in title 38 of the United States Code who was discharged or released from a period of not fewer than ninety days of service in the active military, naval, air or space service. A spouse or dependent of such a veteran. And an eligible recipient entitled to educational assistance under 38 U.S.C. 3319 while the transferor is on active duty, or under 38 U.S.C. 3311(b)(8), or to rehabilitation under 38 U.S.C. 3102(a), or to educational assistance under 38 U.S.C. 3510, each as those sections existed on January 1, 2023. Translated: a Post-9/11 GI Bill transferee whose sponsor is still serving, a Fry Scholarship recipient, a Chapter 31 Veteran Readiness and Employment participant, and a Chapter 35 Dependents' Educational Assistance recipient are all named. Ninety days is the whole of the service test on the veteran route. No rating, no wartime period, no discharge characterisation in the section itself beyond discharge or release. Then the condition, which is unlike anything else in this catalog. The person is treated as a resident student "if the person is registered to vote in Nebraska and demonstrates objective evidence of intent to be a resident of Nebraska". Voter registration is not one of several acceptable proofs; it is stated as a requirement alongside the evidence of intent. A person under eighteen is excused from it. Subsection (2) then lists what counts as objective evidence of intent: a Nebraska driver's licence, a Nebraska state identification card, a Nebraska motor vehicle registration, or documentation that the individual is registered to vote in Nebraska. A veteran who is not a United States citizen, or who for any other reason cannot register to vote, should raise the point with the institution rather than assume the section is closed to them, because the federal law this kind of provision implements does not contemplate that result. This catalog records the words of the statute and does not resolve how an institution applies them. Federal law sets the floor under this section and reaches people it does not name. 38 U.S.C. 3679(c) requires a public institution, as a condition of VA approval, to charge the resident rate to a covered individual living in the state and using Chapter 30, 31, 33 or 35 assistance, or Chapter 1606 Selected Reserve assistance for academic periods beginning on or after August 1, 2026 under Public Law 119-55, with no window after discharge since August 1, 2021 under Public Law 116-315. A drilling reservist on Chapter 1606 who has never served ninety days of active duty is outside 85-502.01 and inside the federal rule from August 2026. The federal rule does let an institution require a showing of intent to establish residency by means other than physical presence, which is the room Nebraska's voter registration condition sits in, but a covered individual who shows intent another way has a federal argument that registration cannot be the only door. The practical advice is simple and it is about sequence. Register to vote in Nebraska and get a Nebraska driver's licence before the term starts, not after. Residency for tuition is generally determined as at the start of a term, and a veteran who enrols first and registers later may pay non-resident rates for that term. This section is separate from the Nebraska Waiver of Tuition under 80-411, and the two work together: 85-502.01 makes the student a resident, and 80-411 then waives the resident tuition for a qualifying dependent. The waiver requires the institution's in-state tuition standard to be met, so for many families this section is the step that makes the waiver usable.

Expands benefits Removed the three-year window after discharge from the rule that public schools charge covered veterans in-state tuition.

Struck "less than three years before the date of enrollment in the course concerned" from 38 U.S.C. 3679(c)(2)(A), for terms beginning on or after August 1, 2021. A veteran with ninety days of active service using a covered VA education benefit and living in the state must be charged the resident rate at a public institution however long ago the discharge was. State guides and at least one catalog entry still described the old window.
