Missouri In-State Tuition and Academic Credit for Military Service

Separating service members, current Guard and reserve members, and dependents of members stationed here all get resident tuition, on three different statutes with three different conditions. The Guard route is strictly last-dollar where the Returning Heroes cap is not.

Also called: 173.1150, 173.1153, 173.1155, 41.890, 173.1158, in-state tuition, resident tuition, ACE credit, military transfer credit.

For: Veteran or service member, spouse, child.

Where it applies

Written for the jurisdictions listed here.

Four separate provisions give resident tuition to different military populations, and they are not interchangeable. Separating service members. Section 173.1150 gives student resident status, for admission and in-state tuition at any approved public four-year institution and in-state in-district tuition at any approved two-year institution, to an individual who is in the process of separating from any branch of the military forces of the United States with an honorable discharge or a general discharge. The individual must demonstrate presence and declare residency in Missouri, and for a community college within that college's taxing district. Note that a general discharge is enough here, which is not true of every Missouri veteran provision. Veterans already out of service. Section 173.1150 reaches only someone in the process of separating, so a veteran discharged years ago who moves to Missouri relies on federal law instead. Under 38 U.S.C. 3679(c), a public institution must charge the in-state rate to a covered individual using chapter 30, 31, 33 or 35 benefits who lives in Missouri while enrolled, whatever the formal state of residence: a veteran discharged after at least 90 days of active service, a spouse or child using transferred Post-9/11 or Fry Scholarship entitlement, and anyone entitled to Veteran Readiness and Employment or Dependents' Educational Assistance, and from August 1, 2026 anyone using the Montgomery GI Bill Selected Reserve under 10 U.S.C. chapter 1606 (Public Law 119-55). Since terms beginning August 1, 2021 there is no limit on how long ago the veteran was discharged (Public Law 116-315, section 1005). A veteran not using one of those benefits has no Missouri route to resident tuition except ordinary domicile. Current Guard and reserve members. Section 173.1153, amended in 2025, deems any individual currently serving in the Missouri National Guard or in a reserve component of the Armed Forces of the United States to be domiciled in Missouri for in-state tuition at any approved public institution, for undergraduate and graduate degree programmes. The individual must demonstrate presence in Missouri, or in the community college's taxing district. That section carries a sequencing rule worth comparing with the Returning Heroes Act. Subsection 3 requires all other federal and state aid to be reported and then says the tuition limitation "shall be provided after all other federal and state aid for which the individual is eligible has been applied", and that no individual may receive more than the actual cost of attendance. Section 173.900, in the same chapter, lets a combat veteran choose to take the benefit first. Same chapter, opposite rules, and the Guard member has no election. Dependents. Section 41.890 provides that military personnel stationed within the state under military orders, their spouses, and their unemancipated children under twenty-four who enrol in a Missouri community college, college or state university are regarded as holding Missouri resident status for undergraduate and graduate degree programmes. Section 173.1155 covers dependents of military personnel assigned geographically elsewhere. Academic credit. Section 173.1158 required the coordinating board for higher education to adopt a policy, by January 1, 2014, requiring every public postsecondary institution in Missouri to award educational credits to an enrolled student who is a veteran for courses that were part of the student's military training or service, where the courses meet American Council on Education standards or equivalent. Read the rest of that sentence before relying on it. The credit must also be "determined by the academic department or appropriate faculty of the awarding institution to be equivalent in content or experience to courses at that institution", and all credit deemed acceptable "must meet the scope and mission of the awarding institution". Those two clauses hand the decision back to the department. The section obliges the institution to have a policy and to run the transcript through it; it does not oblige the institution to award any particular credit, and it contains nothing like the bar other states have placed on reducing a whole military transcript to physical education credits.

Expands benefits Extends deemed Missouri domicile for in-state tuition to graduate programs for Guard and reserve members.

Section 173.1153 deems any individual currently serving in the Missouri National Guard or in a reserve component to be domiciled in Missouri for in-state tuition at any approved public institution, and the current text reaches undergraduate and graduate degree programmes. The section conditions the benefit on demonstrating presence in Missouri, or within the taxing district for a community college, and subsection 3 makes it strictly last-dollar: the limitation is provided only after all other federal and state aid has been applied, and no individual may receive more than the actual cost of attendance. Tracked because section 173.900, in the same chapter, gives a combat veteran the opposite right, an express discretion to take the tuition limitation before other federal and state aid, and the two sequencing rules produce materially different outcomes for a student holding Post-9/11 entitlement. A Guard member who is also a combat veteran should be told which section to claim under.

Expands benefits Removed the three-year window after discharge from the rule that public schools charge covered veterans in-state tuition.

Struck "less than three years before the date of enrollment in the course concerned" from 38 U.S.C. 3679(c)(2)(A), for terms beginning on or after August 1, 2021. A veteran with ninety days of active service using a covered VA education benefit and living in the state must be charged the resident rate at a public institution however long ago the discharge was. State guides and at least one catalog entry still described the old window.
