Maine State Employment Veterans Preference

A qualified veteran who applies for a Maine state job is guaranteed an interview, and the Bureau of Human Resources helps a veteran who is not hired find other openings. State employees receive 17 paid workdays of military leave a year.

Also called: hiring preference, guaranteed interview, state job, Bureau of Human Resources, 17 workdays, military leave, Gold Star spouse, DD214.

For: Veteran or service member, spouse, survivor.

Where it applies

Written for the jurisdictions listed here.

Maine's state hiring preference is structured differently from the points systems most states in this catalog use, and the difference is worth understanding before applying. Maine guarantees an interview rather than adding points to an examination score. A veteran who meets the qualifications for a posted state position is interviewed. That helps a candidate whose written application undersells military experience, and it does nothing for a candidate who does not meet the stated minimum qualifications, so the qualifications section of a posting is where the work is. If the veteran is not hired, the Bureau of Human Resources assists them in finding other openings in state government. That is an active referral function rather than a form letter. Eligibility reaches an active duty veteran or a reserve component veteran with an honorable discharge, documented with the DD214. A surviving spouse eligible for the Gold Star Lapel Button qualifies as well, documented with DD Form 1300. From July 29, 2026 the interview reaches military spouses too. Public Law 2025, chapter 634, amended 5 M.R.S. section 7054-B so that the spouse of an "eligible service member", meaning a person serving on active duty or in the Reserves or National Guard, is offered an interview on meeting the minimum qualifications, and is retained in a reduction in force ahead of other employees in the same classification with equal seniority, status and performance reviews, as veterans and Gold Star spouses already were. The Revisor's online statute text, current through October 1, 2025, does not yet show the change. No disability rating is part of the preference, so a rating filter never hides this entry. That is a real difference from the federal ten-point preference and from most of the states in this catalog, where a compensable rating moves a candidate up a tier. In Maine it does not, because there are no tiers. Two employment provisions sit alongside it. A Maine state employee receives 17 workdays of paid military leave per calendar year, with unpaid leave available if the service exceeds that, and reemployment to the same position after short-term service or to a similar position after long-term service. And a member of the Maine National Guard on state active duty is paid at least the equivalent of active duty pay and allowances, with a floor of twelve hours a day at the state minimum wage. Occupational licensing is the other half of getting to work. The Office of Professional and Occupational Regulation recognises out-of-state licences, issues temporary licences while full licensure is processed, grants credit for military training and experience, and gives processing priority to veterans and surviving spouses. A veteran whose trade is licensed should start there rather than with a job application, because the licence is usually the gate. A family on military orders also has a federal right that is stronger than a temporary licence. Since December 23, 2024, 50 U.S.C. 4025a, as rewritten by section 587 of Public Law 118-159, requires Maine to treat as valid, within its scope of practice, a licence in good standing that a service member or spouse holds elsewhere when they move to Maine on military orders, on application with the orders, a marriage certificate for a spouse and a notarized affidavit; a board that cannot act within 30 days may issue a temporary licence meanwhile. Licences held under an interstate compact follow the compact. It covers people serving and their spouses, not veterans after separation. The CareerCenter system runs the employment services and applies a priority of service for veterans and eligible spouses ahead of non-veterans.

Expands benefits Requires a state to treat a service member or spouse on military orders as licensed there on the strength of a licence held elsewhere.

Amended 50 U.S.C. 4025a generally, effective December 23, 2024. A service member or spouse who relocates on military orders and holds a licence in good standing elsewhere has it treated as valid for its scope of practice in the new state on application with the orders, a marriage certificate for a spouse and a notarized affidavit; a board that cannot act within 30 days may issue a temporary licence with the same rights. Licences held under an interstate compact follow the compact. State military spouse licensing entries that describe only the state procedure understate what a family on orders is owed. Veterans are outside the section.
