Where it applies

Written for the jurisdictions listed here.

The Kansas national guard educational assistance act pays tuition and required fees for a serving member of the Kansas National Guard at a Kansas educational institution. An eligible guard member is any current member of the Kansas National Guard who is not under a suspension of favorable action flag and is not currently on the unit unfavorable information file. That is the whole eligibility test in the statute: current membership and clean administrative standing. There is no rating, no deployment history and no minimum length of prior service. The assistance is an amount equal to the tuition and required fees for not more than fifteen credit hours each semester. The Board of Regents administers it and applies the usual conditions: satisfactory academic progress, a minimum grade point average, enrolment in an educational programme leading to a certificate, diploma or degree, a FAFSA on file, and federal tuition assistance applied for and used first where the member is eligible for it. The price is a service obligation. To participate, the member must agree in writing to complete their current service obligation in the Kansas National Guard and to serve actively in good standing for not less than twenty-four months after the last semester for which assistance is received. A member who leaves early repays. The institution list is wider than most state programmes reach. It covers community colleges, the municipal university, state educational institutions, technical colleges, the institute of technology at Washburn University, and a not-for-profit independent accredited institution that is operated independently of the state, maintains open enrolment, offers online education and offers exclusively competency-based education programmes. That last clause was written for a specific kind of institution and it is narrow: an ordinary private Kansas college does not qualify merely by being accredited. The newest change is the transfer. The 2025 amendment added a definition of "dependent" as an individual registered as an eligible dependent of the sponsoring guard member in DEERS, and opened the programme to dependents so a member can pass unused benefit to a family member. A member considering whether to use the last of their own hours now has a second option. Kansas also runs the EMERGE programme for advanced degrees, separately from this act, with longer service obligations: forty-eight months after a master's degree with a minimum 2.75 cumulative grade point average, and seventy-two months after a professional or doctoral degree with a minimum 3.00. This is a Guard programme, not a veterans programme. A separated veteran is outside it, and the federal GI Bill is the instrument that follows a member out of service.

Expands benefits Lets a Guard member pass unused educational assistance to a dependent.

Amended the Kansas national guard educational assistance act to add a definition of "dependent" as an individual registered as an eligible dependent of the sponsoring guard member in the defense enrollment eligibility reporting system, and to let a member pass unused benefit to that dependent. Before this the assistance was usable only by the member. Tracked because it changes the calculation a serving member makes about whether to spend their own remaining hours, and because guidance written before the 2025 session describes the programme as member-only.
