Yuba County Employees: Buying CalPERS Credit for Military Service
Yuba County's CalPERS contract lets its miscellaneous employees (since June 24, 1999) and safety employees (since August 15, 2003) buy up to four years of active military service as public service for their pension, under Government Code 21024; the employee pays the contributions, and the county must tell new hires of the right.
Also called: CalPERS, pension, service credit, military service credit, buy back, 21024, county employees, safety members, miscellaneous members, Ordinance 1245, Ordinance 1313, Marysville, Wheatland, Olivehurst, Linda, Plumas Lake, Beale Air Force Base, Browns Valley, Loma Rica, Dobbins, Camptonville, Smartsville, Oregon House, Brownsville.
The county's election. The Ordinance Code records the CalPERS contract amendments: "(9) June 24, 1999 - § 21024 - Military Service Credit as Public Service for Miscellaneous Members Only. (10) July 1, 2003 - § 21024 Military Service Credit as Public Service for Safety Members Only" (section 3.40.010). Section 3.40.037 (Ordinance 1245) approves the amendment "to provide § 21024 which allows miscellaneous members with military service credits to buy that credit as PERS service", and section 3.40.038 (Ordinance 1313) the one "effective August 15, 2003 ... to allow safety members with military service credits to buy that credit as PERS service".
What the statute gives. Government Code 21024 counts as public service "active service with the Armed Forces of the United States or the Merchant Marine of the United States", including a period of rehabilitation that is not purely educational, and six months after it, before the member's first employment with the employer. The member who elects the credit "shall make the contributions as specified in Sections 21050 and 21052" (the member pays the cost). The credit cannot count military service already credited another way and cannot exceed four years in all, the member picks which periods to buy, the election must be made while employed by the county, and "An employer shall inform a new employee at the time of hire of their rights to purchase service credit under this section".
How. A county employee who is a CalPERS member asks CalPERS for a cost estimate for military service credit (with the DD-214), through Human Resources, (530) 749-7860.
