Yavapai County Jobs: Paid Military Leave

Yavapai County employees in the Guard or Reserve get paid military leave of 240 hours in two consecutive years under County policy 5.09, last revised in 2017. ARS 38-610 also caps it at three weeks of regular hours a year and bars charging the time to vacation, which the policy's wording on using accrued leave first does not reflect.

Also called: military leave, county jobs, USERRA, 38-610, 26-168, Guard, Reserve, policy 5.09, reinstatement.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

Yavapai County's Human Resources Policy 5.09, Military Leave (approved April 20, 2009, revised June 18, 2017), covers employees and elected officials. Paid leave. Employees are granted leave "without loss of time, pay, or performance rating" on days of training or active duty under orders, up to thirty days in any two consecutive years, 240 hours for a full-time employee. ARS 38-610, which governs every Arizona county, sets the paid leave by hours: up to three times the regular weekly hours each federal fiscal year and up to six times in any two consecutive years, and it says time under orders "may not be deducted from the vacation period with pay to which the officer or employee is otherwise entitled", and that a day not scheduled for work may not be charged. The policy's leave sentence. The policy says the employee "is permitted to use any accrued annual leave, holiday or compensatory time before military leave will commence". Using vacation is the employee's choice; neither ARS 38-610 nor USERRA lets the County require it before paid military leave starts. Longer service and return. Absence can run up to five years, longer for the reasons USERRA allows. Employees must report back or apply within the USERRA time limits: the next work period for service under 31 days, 14 days for 31 to 180 days, and 90 days after longer service, with up to two years more for recovery from an injury. They return to the position they would have held, or one of like seniority, status and pay, and the County pays both shares of retirement contributions for the time away, which counts as credited service. A probationary employee finishes the rest of probation on return.
