Utah Free College Classes for Veterans on Surplus Space

Any Utah veteran, at any age, may enrol at a public institution in classes with surplus space and is exempt from tuition and other charges except a registration fee the board sets. It is the least known education benefit in Utah, it has no degree requirement and no cap, and the price of it is that you are admitted only after the regularly enrolled students.

Also called: Utah Code 53H-11-304, 53H-11-304, 53B-8-103, surplus space, senior citizens and veterans, registration fee, audit, space available, age 62.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

One section, written for two groups, and the veteran half of it is almost never mentioned in any guide to Utah benefits. The finding the Legislature made. Section 53H-11-304, subsection 1: "The Legislature finds that substantial benefits would accrue to the state, as well as those directly involved, through making higher education more accessible to senior citizens and veterans who possess more time for learning but with less funds for such purposes." What it requires. Subsection 2, paragraph (a): "An institution of higher education shall allow Utah residents who have reached 62 years old or are veterans as defined in Section 68-3-12.5 to enroll at the institution, in classes for which the Utah residents may be qualified, on the basis of surplus space in regularly scheduled classes and in accordance with this section and implementing rules." Note the disjunction: 62 years old **or** a veteran. A veteran of any age is inside this section. There is no rating, no wartime period, no discharge condition beyond the general definition's honorable or general, and no requirement to be pursuing a degree. What it costs. Paragraph (b): "These persons are exempt from tuition and other charges, except for a quarterly registration fee established by the board." So tuition is free and so are "other charges", which on its face reaches the fees that every other Utah waiver in this file expressly excludes. What you pay is a registration fee set by the Utah Board of Higher Education. The statute does not state the amount, so ask the institution's registrar for the current figure; it is the only cost the section authorises. The price of the benefit, and it is real. Enrolment is "on the basis of surplus space in regularly scheduled classes". Subsection 3: "Enrollment of senior citizens under this section is permissible after regularly enrolled students have been assigned and admitted to available classroom space in accordance with regular procedures and normal teaching loads in that space within the approved budget." Subsection 4: enrolments are determined by each institution under board rules "in accordance with findings of fact that space is available for the enrollments without increased instructional cost." So you register last, you cannot displace a paying student, and a popular course may simply have no room. For someone with a schedule that can flex, that is a modest price for free coursework. For someone who needs a specific class in a specific term to finish a credential, it is not a substitute for the Purple Heart waiver, the military survivors waiver or the Veterans Tuition Gap Program. A drafting asymmetry worth knowing about. Subsection 2 covers senior citizens and veterans together. Subsections 3 and 5 mention only senior citizens: subsection 3 sequences enrolment for "senior citizens", and subsection 5 says "Institutional enrollment reports shall show senior citizens separately, and the senior citizens are not counted as full-time students." Read literally, the surplus-space sequencing rule in subsection 3 and the reporting rule in subsection 5 do not mention veterans at all, even though subsection 2 plainly conditions veteran enrolment on surplus space. Institutions administer the whole section as one programme. If an institution tells you the section is only for people over 62, subsection 2 is the answer, and it names veterans expressly. Subsection 6 lets the board make reasonable rules to carry out the purpose of the section, so the operative detail, including the registration fee and how surplus space is determined, lives in board policy and institutional practice rather than in the statute. How to use it. Contact the institution's registrar or veteran services office and ask specifically about the section 53H-11-304 space-available enrolment for veterans, the current quarterly registration fee, and when in the registration cycle you may enrol. Because the benefit has no cap and no degree requirement, it is the natural next step for a Purple Heart recipient who has used the $15,000 graduate cap, for a veteran whose GI Bill is exhausted and who is not in the final year a Tuition Gap grant requires, and for anyone who wants a single course rather than a programme. Where the section lives now. Renumbered and amended by chapter 8 of the 2025 first special session, which moved the higher education title from 53B to 53H. Guides citing section 53B-8-103 are citing the predecessor.

No change to benefits Renumbers every veteran higher education benefit from Title 53B into Title 53H without changing its substance.

Renumbered Utah’s higher education provisions out of Title 53B and into a new Title 53H, carrying with them every veteran and survivor education benefit in the state. Resident student status, which contains the clause granting a veteran resident tuition "regardless of whether the military veteran served in Utah", moved to section 53H-11-202. The Purple Heart tuition waiver became section 53H-11-303, the Scott B. Lundell Military Survivors’ tuition waiver section 53H-11-308, the surplus-space enrolment provision for senior citizens and veterans section 53H-11-304, the Veterans Tuition Gap Program section 53H-11-413, credit for military service and training section 53H-3-703, and community college enrolment preference for veterans section 53H-3-1103. Tracked because the renumbering is invisible in the substance of any of those benefits and total in its effect on citations: every guide, institutional web page and departmental document citing chapter 53B-8 or 53B-13c for a Utah veteran education benefit now points at a repealed location. Two of the renumbered sections were then amended in the 2026 general session, section 53H-11-202 by chapter 180 and section 53H-11-303 by chapter 230, so the current text of both is later than the renumbering.
