Orange County Superior Court: Veterans Treatment Court and Military Diversion
Orange County's Veterans Treatment Court, open since 2008, is a five-phase programme of at least 18 months, and the court runs pre-plea military diversion in Department C46. The court's military diversion page still says Penal Code 1001.80 applies only to misdemeanors; since January 1, 2025 it reaches most felonies too.
Also called: veterans court, veterans treatment court, VTC, military diversion, 1001.80, SB 1025, Community Court, C46.
The Orange County Superior Court runs two programmes for people who served; see the California entry on military diversion and sentencing.
Veterans Treatment Court. Opened in November 2008 at the Community Court building, in partnership with VA, which funds a full-time case manager. It serves "US military service personnel" in the criminal justice system who need treatment for PTSD, traumatic brain injury or other serious mental health problems. VA-eligible participants are treated by VA; those who are not are treated by the county Health Care Agency, so a veteran without VA eligibility is not shut out. It runs in five phases for at least 18 months, with counselling, a care coordinator, probation supervision, drug and alcohol testing and regular court appearances.
Military Diversion. A pre-plea programme under Penal Code section 1001.80 for current and former members who may be suffering from sexual trauma, TBI, PTSD, substance abuse or mental health problems as a result of service. The defence obtains an assessment from VA, the Health Care Agency or another agency and emails a motion to [email protected]; the judicial officer in Department C46 decides. Diversion lasts no more than two years and ends in dismissal on completion.
Where the court's page is out of date. The court's Military Diversion Program page says section 1001.80 "applies to a defendant accused of a misdemeanor offense". Senate Bill 1025 (Stats. 2024, ch. 924) rewrote subdivision (a) to cover "a misdemeanor or felony offense" not listed in subdivision (o), from January 1, 2025; for a felony the condition must also have been a significant factor in the offense. The collaborative courts page describes the programme without the misdemeanor limit. A defendant charged with a felony should ask for diversion.
