New Jersey Disabled Veteran Business Set-Aside and Veteran Peddler Licence
State agencies aim to award at least 3 percent of contracts to New Jersey businesses at least 51 percent owned by veterans with any service-connected disability, and a resident veteran discharged under honorable conditions has a statutory right to a peddler's licence.
Contracting. N.J.S.A. 52:32-31.5 sets a goal that each state contracting agency award at least 3 percent of its contracts to disabled veterans' businesses, directly or through subcontracts, and set contracts aside for them when necessary. Under N.J.S.A. 52:32-31.2 a disabled veterans' business has its principal place of business in New Jersey and is at least 51 percent owned and controlled by residents whom VA certifies as "having any degree of service-connected disability", or is verified by VA as a service-disabled veteran-owned small business. A separate goal for businesses owned by veterans without a disability is in N.J.S.A. 52:32-49 to 52:32-54. Counties and municipalities may run their own set-asides under N.J.S.A. 40A:11-41.
Peddling. N.J.S.A. 45:24-9 gives "every person who has been honorably discharged or discharged under honorable conditions from the active military service" who is a New Jersey resident "the right to hawk, peddle and vend any goods, wares or merchandise or solicit trade within this State" by taking out a licence from the county clerk. P.L.2019, c.211 added the general discharge. The right does not extend to a public beach or boardwalk, and municipalities may still regulate street vending by ordinance. The Army benefits library describes the licence as free.
