Where it applies

Written for the jurisdictions listed here.

This entry exists to close a door, not to open one. North Dakota's Century Code still carries three chapters of veterans' adjusted compensation, each one a state bonus with real money in it, and every one of them stopped taking applications years ago. A veteran who finds them by searching the code, or who is told by a relative that North Dakota pays a bonus, is reading live-looking text for a program that has ended. Chapter 37-27, war and armed conflict veterans' compensation: applications could be filed after July 1, 1993, "but not later than December 31, 1994". Chapter 37-26, Operation Desert Shield and Desert Storm veterans' compensation: applications could be filed after April 1, 1991, but not later than six months after the end of that period of service. Chapter 37-28, military operations adjusted compensation, is the most recent and the one most likely to be mistaken for current. It covered Guard members, North Dakota residents of the reserve, and active component members mobilised after December 5, 1992, for a period of service ending June 30, 2021. It paid fifty dollars a month for domestic service, one hundred dollars a month for foreign service with an expeditionary medal or campaign badge, two thousand five hundred dollars in place of monthly payments where a Purple Heart was earned in that mobilization, and five thousand dollars to the beneficiary of a veteran who died as a result of active service. Applications could be filed with the adjutant general "through June 30, 2021, or in the case of a soldier mobilized on June 30, 2021, not later than six months after the end of the mobilization period of service". Both of those dates have passed. What is worth keeping from the chapters, because it applies to anything a veteran did receive under them. Section 37-28-07 makes payments exempt from all state and local taxes, including tax determined under 57-38-30.3, and exempt from levy, garnishment, attachment and sale on execution. Any pledge, mortgage, sale, assignment or transfer of a right or claim to a payment is void, and payment may not be denied because of sums owed to the state or a political subdivision. The single exception is a debt to the veterans' aid fund, which the adjutant general deducts before paying the remainder. If someone is telling a North Dakota veteran today that there is a state bonus to apply for, the thing to do is ask which chapter, and then read the filing deadline in it. There is no current North Dakota veterans' bonus.

Chapter 37-28 paid fifty dollars a month for domestic service, one hundred a month for foreign service with an expeditionary medal or campaign badge, two thousand five hundred dollars where a Purple Heart was earned in the mobilization, and five thousand dollars to the beneficiary of a veteran who died as a result of active service, for service between December 5, 1992 and June 30, 2021. Section 37-28-03 allowed applications to be filed with the adjutant general through June 30, 2021, or for a soldier mobilized on that date not later than six months after the end of the mobilization. Both dates have passed. The two older bonus chapters closed earlier: 37-27 on December 31, 1994 and 37-26 six months after the end of its period of service. All three chapters are still printed in the Century Code with no indication on their face that the windows have shut, which is why the catalog carries an entry whose job is to say the programs are closed.
