VA Native American Direct Loan in the Northern Mariana Islands
Article XII of the Commonwealth Constitution restricts long-term interests in land to persons of Northern Marianas descent, which is what makes the territory eligible for VA’s direct loan and what makes the ordinary guaranty nearly unusable.
Also called: NADL, Native American Direct Loan, home loan, VA home loan, Article XII, Northern Marianas descent, restrictions on alienation, 38 U.S.C. 3765, trust land.
Article XII, Section 1 of the Commonwealth Constitution reads: "The acquisition of permanent and long-term interests in real property within the Commonwealth shall be restricted to persons of Northern Marianas descent." Section 4 defines a person of Northern Marianas descent as someone with at least one-quarter Northern Marianas Chamorro or Northern Marianas Carolinian blood or a combination of the two. The restriction is not incidental; it is required by the Covenant that made the Commonwealth part of the United States, and it is among the most restrictive land ownership provisions anywhere under American jurisdiction.
That is the fact a veteran has to plan around, and it cuts both ways.
Against you: a lender taking a mortgage needs to be able to realise the security, and a permanent or long-term interest in Commonwealth land cannot be conveyed to a person outside the descent class. The ordinary VA home loan guaranty is built on the assumption that a mortgageable fee interest exists and can be sold. In the Commonwealth it barely functions. The Government Accountability Office pulled VA data for veterans living in each territory: the home loan guaranty was used by zero veterans living in the Northern Mariana Islands in fiscal 2021, zero in 2022, and three in 2023. Guam, in the same VA region, recorded 577, 300 and 231.
For you: the same restriction is what brings the territory inside VA's Native American Direct Loan. The statute at 38 U.S.C. § 3765 defines qualifying trust land to include land "on any island in the Pacific Ocean if such land is, by cultural tradition, communally-owned land, as determined by the Secretary," and VA has made that determination for three territories, American Samoa, the Commonwealth of the Northern Mariana Islands and Guam. GAO described the Pacific territory category as land where traditional leaders or territorial government agencies hold legal title subject to restrictions on alienation, for example where conveyance may be restricted to descendants of the native population. That is Article XII.
Under the Native American Direct Loan VA is the lender rather than a guarantor: a thirty-year fixed mortgage, usually with no down payment, at a rate VA publishes rather than a bank prices. The rate VA published most recently starts at 2.5 percent. Check the current figure before planning around it.
The memorandum of understanding requirement, which blocks most mainland tribes, is already satisfied here. As of September 30, 2021 VA held MOUs with 109 eligible entities, and four of those were the State of Hawaii and the three Pacific territorial governments, the Commonwealth among them.
The real work is the same as everywhere the programme operates: you must be able to convey a meaningful interest in qualifying land to VA as security. In the Commonwealth that means the Article XII question has to be answered for your specific parcel and your specific descent status before a loan application means anything. Take it to VA and to the Department of Public Lands first.
Scale, so you know what to expect. VA originated 76 Native American Direct Loans across all three Pacific territories in the ten fiscal years 2012 through 2021, against an estimated 5,200 potentially eligible veterans there. HUD's Section 184 programme, which covers comparable land on the mainland, does not offer loans in any of the Pacific territories, so the list of alternatives is short.

No rating requirement
The Native American Direct Loan turns on a Certificate of Eligibility, credit, income and land, not on a disability percentage. A service-connected rating of ten percent or more waives the VA funding fee, which is the only place a rating touches this loan.
Article XII decides whether you can pledge the land
The acquisition of permanent and long-term interests in Commonwealth real property is restricted to persons of Northern Marianas descent, defined as at least one-quarter Northern Marianas Chamorro or Carolinian blood. Whether you can convey a meaningful interest to VA as security has to be answered for your parcel and your status before anything else.
The territorial MOU is already signed
The programme operates only where the governing entity holds a memorandum of understanding with VA. The Commonwealth government is one of only four such agreements covering Hawaii and the Pacific territories as of September 30, 2021.
The ordinary guaranty is close to unusable here
VA data reported by GAO show the home loan guaranty used by zero veterans living in the Northern Mariana Islands in fiscal 2021 and 2022 and three in fiscal 2023. Do not assume a guaranty pre-approval from a mainland lender will translate.
