A city or county employee in the Guard or reserves ordered to full-time active duty for more than 30 days gets the difference between military and civilian pay each week, dependent health coverage at no cost, continued PERF contributions and one or two extra weeks of vacation, beyond the 15 paid days Indiana law gives.

Also called: military leave, differential pay, Guard, reserves, activation, PERF, health insurance, city employee, county employee.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

Section 291-210 of the consolidated code grants military leave under State and federal law, including 15 eight-hour days of paid leave, and then adds supplemental benefits for an employee of the City of Indianapolis or Marion County, including sheriff's, police and fire merit officers, who serves in the National Guard or a reserve component and is ordered by the Governor or the President to full-time active duty for more than 30 days. What the employee gets. A weekly payment equal to any shortfall between active-duty pay and normal civilian pay; the city or county pays both the employee and employer shares of dependent health coverage; the employer's PERF contribution continues (and for sheriff's merit officers the employee's pension contribution too); and an extra week of paid vacation for 30 to 179 days of continuous active duty, or two weeks for 180 days or more. Notify the Office of Finance and Management's human resources division with the orders as soon as possible after activation. Firefighters get up to 144 work hours of paid military leave a year instead of the 15 days (section 252-305).
