Kentucky Tuition Waiver for the Family of a Totally Disabled Veteran
Tuition waived at Kentucky public institutions for the spouse at any age and children under 26 of a veteran rated 100% service-connected, with no wartime service needed. Forty-five months, tuition only, and the student need not live in Kentucky.
Also called: tuition waiver, dependent tuition, KRS 164.515, 45 months, age 26, spouse, disabled veteran, KDVA, Chapter 35.
KRS 164.515 is the Kentucky tuition waiver for the family of a living disabled veteran, and it is the one most families qualify under. The spouse of a qualifying veteran, at any age, and any child, stepchild, or orphan under twenty-six, pays no matriculation or tuition fees at any state-supported institution of higher education or state-supported vocational training school.
The qualifying veteran is one of: a one hundred percent service-connected disabled veteran regardless of wartime service; a permanently and totally disabled war veteran; a permanently and totally disabled member of the Kentucky National Guard or a Reserve Component injured on state active duty, active duty for training, or inactive duty training; a prisoner of war; or a member of the Armed Services declared missing in action.
The phrase "regardless of wartime service" in the hundred percent branch is doing real work. A peacetime veteran rated one hundred percent qualifies. The permanent and total branch is the one that carries a wartime requirement, and it exists for veterans rated P&T for pension purposes rather than at one hundred percent for compensation.
Six things about this waiver are routinely misstated.
It covers tuition and nothing else. KDVA is explicit: the waiver exempts the student from paying tuition only. Room, board, books, and fees are the family's. A student comparing this against Chapter 35 Dependents' Educational Assistance is comparing a tuition exemption against a monthly cash stipend, and the two are separate benefits that can both be pursued.
The student does not have to live in Kentucky. The veteran must be a current Kentucky resident, or have been a resident at death. KDVA states that Kentucky residency of the applicant is not necessary, so long as the student attends a qualifying Kentucky institution in person or online. Families who moved out of state after the veteran's rating frequently assume they are disqualified and are not.
Private and out-of-state schools do not qualify. Only Kentucky public two-year, four-year, and vocational-technical institutions.
The cap is forty-five months of classes, or the lesser number of months required for a certificate of completion, and entitlement also ends on receipt of a degree or certificate or, for a child, on turning twenty-six.
Military service by the student extends the age limit. KRS 164.515(5) provides that a spouse, child, stepchild, or orphan who enlists or fulfils a military obligation and is discharged under honorable conditions has the time spent in service compensated by like time beyond age twenty-six. KDVA confirms this is the only extension past twenty-six it will grant. A child who serves four years does not lose the waiver to the clock.
Marriage does not disqualify a child. KRS 164.515(6) says in terms that the marriage of an eligible child, stepchild, or orphan shall not deny full entitlement. A stepchild must be a member of the veteran's household.
On unemployability the statute is ambiguous and worth flagging rather than guessing. KRS 164.515(2) requires the living parent to be "rated permanently and totally disabled for pension purposes or one hundred percent (100%) disabled for compensation purposes" by VA or DoD. A veteran paid at the hundred percent rate through individual unemployability is compensated at one hundred percent while rated below it, and whether that satisfies the second branch is a question KDVA decides on the certification. Apply and let the coordinator rule.
Applications go through the KDVA tuition waiver coordinator, not the school. Do not apply before you are accepted and certain you will attend, allow at least thirty days, and if you change schools it is your responsibility to have the original school tell the new one how much entitlement remains.

Gate
Rule
Veteran rated 100% service-connected, wartime service not required
KRS 164.515(1) names a one hundred percent service-connected disabled veteran regardless of wartime service, so a peacetime veteran at one hundred percent qualifies. The alternative branches are a permanently and totally disabled war veteran, a permanently and totally disabled Kentucky National Guard or Reserve member injured on state active duty or duty for training, a prisoner of war, or a member declared missing in action.
Unemployability is not settled here
KRS 164.515(2) requires a living parent or spouse to be rated permanently and totally disabled for pension purposes or one hundred percent disabled for compensation purposes. A veteran paid at the total rate through individual unemployability is compensated at one hundred percent while rated below it, and the statute does not resolve whether that meets the test. The Kentucky Department of Veterans Affairs decides it on certification, so apply rather than self-screen.
Spouse any age, child under 26
The spouse qualifies regardless of age. A child, stepchild, or orphan must be under twenty-six. A stepchild must be a member of the veteran's household. KRS 164.515(6) provides that the marriage of an eligible child does not deny entitlement.
Forty-five months, tuition only
The waiver runs for a period not exceeding forty-five months to obtain a diploma, or the lesser number of months required for a certificate of completion, and ends on receipt of a degree or certificate. It exempts tuition only. Room, board, books, and fees are not covered, and private and out-of-state schools do not qualify.
The student need not be a Kentucky resident
The veteran must be a current Kentucky resident, or have been one at death. The Kentucky Department of Veterans Affairs states that Kentucky residency of the applicant is not necessary provided the student attends a qualifying Kentucky institution in person or online.
Military service by the student extends the age limit
KRS 164.515(5) compensates a student who enlists or fulfils a military obligation and is discharged under honorable conditions by like time beyond age twenty-six, capped at the forty-five month period. KDVA confirms this is the only extension past twenty-six it grants.
