Where it applies

Written for the jurisdictions listed here.

KRS 158.140(5)(a) is mandatory: a local board of education shall award an authentic high school diploma to an honorably discharged veteran who did not complete high school prior to being inducted into the United States Armed Forces during World War II as defined in KRS 40.010, the Korean conflict as defined in KRS 40.010, or the Vietnam War. The statute defines the Vietnam War for this purpose as August 5, 1964 through May 7, 1975, with the period beginning February 28, 1961 for a member who served in Vietnam before August 5, 1964. Note the word "authentic." The diploma is a real diploma from the district, not a certificate of appreciation. Now the gap, and it is the reason a Vietnam veteran sometimes gets turned away. KRS 158.140(5)(b) directs the Kentucky Board of Education, in consultation with the Kentucky Department of Veterans Affairs, to promulgate regulations establishing the guidelines for awarding these diplomas. The regulation that exists is 704 KAR 7:140, and it is titled "World War II and Korean Veterans diplomas." Its text covers a veteran of World War II or the Korean conflict and says nothing about Vietnam. KDVA's own page reproduces that regulation, describes the statutory duty as arising under "KRS 158.140(4)," and then directs Vietnam veterans to Operation Recognition, a program it describes as run by local school districts with their own eligibility requirements. So a Vietnam-era veteran reading Kentucky's official guidance is pointed at a discretionary district program, while the statute says a local board shall award the diploma. If a district declines, the statute is the thing to cite, not the regulation and not the KDVA page. The regulation's silence on Vietnam does not shrink a statutory "shall"; it means the regulation has not caught up. The process under the regulation, which is the process districts know: the veteran or a family member sends a discharge certificate showing the period of service and the type of discharge, along with the name of the school and district of enrollment, to the Kentucky Department of Veterans Affairs at 1111 Louisville Road, Frankfort. KDVA forwards the verified documentation to the local board of education. The board verifies that the veteran was enrolled in but did not complete high school before induction. Where the school or district has since been consolidated or reconfigured, the current board with jurisdiction does the verification, so a closed high school is not an obstacle. This benefit is available posthumously in practice through family application, and it has no cost, no deadline, and no rating.

Statute covers Vietnam; the regulation does notKRS 158.140(5)(a)3 names the Vietnam War, defined as August 5, 1964 to May 7, 1975 and reaching back to February 28, 1961 for service in Vietnam before that date. The implementing regulation, 704 KAR 7:140, is titled "World War II and Korean Veterans diplomas" and its text does not mention Vietnam. A district declining a Vietnam veteran should be pointed at the statute.
Honorable discharge and enrolment before inductionThe veteran must have been honorably discharged and must have been enrolled in but not completed high school before being inducted. The local board verifies both, and where the school or district has been consolidated the current board with jurisdiction verifies instead.
