Kansas Property Tax Deferral for Deploying Service Members
A member deploying outside the United States for six months or more may defer the property tax on their principal residence for up to two years, with interest and penalties waived.
Also called: 79-1612, property tax deferral, deployment, mobilization, six months, two years, county clerk, county treasurer.
Section 79-1612 lets a person in full-time military service of the United States who is, or soon will be, mobilised or deployed outside the United States for a period of at least six months solely by reason of military orders defer all or part of the real property tax on their principal place of residence.
The deadline is December 1 of the year in which the claim is filed. The claim form comes from the county clerk and is filed with the county treasurer of the county where the property is located, accompanied by proof of military status in a form the secretary of revenue provides.
The deferral runs for any year in which the person is serving on active military duty, for a period not to exceed two years.
Two features make this better than an ordinary payment plan. Interest and penalties on the deferred tax are waived, which is the whole point: a deployed member is not penalised for the timing of their absence. And a family member or an attorney-in-fact may file the claim on the member's behalf where the military service prevents the member from filing it. That second provision is what makes the section usable, since a member already deployed cannot easily walk into a county clerk's office.
What the section does not do is forgive anything. All deferred taxes become payable when the deferral period ends, or when the property is sold, or when title is transferred to someone other than the person who made the election. A member returning from a two-year deployment faces the accumulated bill, without interest, all at once.
This is a deployment provision rather than a veterans provision, and it is narrower than it first looks: it requires deployment outside the United States, for at least six months, on military orders, and it attaches to the principal residence only.
