Indiana Veterans Treatment Courts

Indiana courts may run veterans' courts that link veterans charged with offences to treatment and services under intensive judicial supervision, and a veterans' court may take a veteran referred from another county.

Also called: IC 33-23-16, veterans court, problem solving court, Justice Reinvestment Advisory Council, diversion.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

IC 33-23-16-10 defines a veterans' court as a problem solving court "focused on addressing the needs of veterans in the court system" by bringing together substance abuse and mental health professionals, local programs and "intensive judicial monitoring", and "linking eligible veterans to individually tailored programs or services". Courts establish them under the rules of the Indiana Supreme Court's problem solving courts board, which also sets minimum eligibility criteria (IC 33-23-16-12(d)). Unusually, IC 33-23-16-12(c) lets a veterans' court "assume jurisdiction over a veteran" who meets the eligibility requirements and "is referred to the problem solving court by a court in another jurisdiction", so a veteran charged in a county without one can ask to be referred. Ask defence counsel or a county service officer which courts operate near you.
