Also called: IC 10-17-10, burial allowance, county commissioners, $1,000, cremation, funeral.

For: Veteran or service member, spouse, survivor.

Where it applies

Written for the jurisdictions listed here.

IC 10-17-10-1: an interested person may claim an allowance from the board of commissioners of the county where the decedent lived if the decedent was an Indiana resident at death and either received a discharge from the armed forces not on the relief fund list of disqualifying conditions or died while serving, or was the spouse or surviving spouse of such a person. The claim states the service, death and discharge and that the body was buried "in a decent and respectable manner" or cremated with the remains not yet interred. The amount is "set by ordinance" and "may not be more than one thousand dollars ($1,000)", and only one claim is allowed per decedent (IC 10-17-10-2). Ask the county auditor or veterans service officer what your county pays. The 2025 act that set the discharge test also added cremation and defined the armed forces to include the Space Force.

Expands benefits Narrows the discharge exclusion across the veterans statutes from 'other than honorable' to a list of disqualifying discharges, and opens the Veterans' Home to all eight uniformed services.

Amended IC 1-1-4-5 so a Hoosier veteran includes active as well as reserve and Guard service, and replaced exclusions of other than honorable discharges in the state and local hiring preferences, the Veterans' Home, the burial allowance, the peddler licence and many other sections with a reference to the list in IC 10-17-12-7.5(2): court-martial, discharge in lieu, security offenses, willful or persistent misconduct, sexual or violent offenses and disallowable separation codes. Opened the Veterans' Home to all eight uniformed services, created the Medal of Honor plate and added the Space Force throughout. Approved May 6, 2025, effective July 1, 2025. In IC 1-1-4-5 the act wrote "under conditions other than conditions set forth in" the list, which read literally inverted the test; House Enrolled Act 1343 of 2026 corrected it.
