Henry County Code: Free Business License for Veterans

Henry County's 1981 ordinance offers a free business license only to a veteran drawing a 100% permanent disability pension who solely owns the business. The State statute, which a county cannot narrow, exempts a disabled veteran rated 10% for wartime service or 25% for peacetime.

Also called: business license, occupation tax, probate court, 43-12-1, Code 3-3-28, self-employed, McDonough.

For: Veteran or service member.

Henry County Code section 3-3-28, from Ordinance 81-1021 of October 21, 1981: "Veterans of the armed forces of the United States may apply for free license; providing, they are drawing a permanent disability pension of one hundred (100) percent and have a certificate of eligibility from the Georgia Department of Veterans Services." The Probate Court verifies it; only one free permit is issued per veteran, for one business, and the veteran must be the sole owner. Where that is narrower than the law. Chapter 12 of Title 43 lets a disabled veteran conduct business in "any county or municipality in this state" without paying the occupation tax or administrative and regulatory fees, on a disability of 10% for a war veteran or 25% for a peacetime veteran, with Georgia residence and no Georgia income tax owed, through a probate court certificate of eligibility and the Department of Veterans Service's certificate of exemption; see the Georgia entry. The State law does not require a 100% rating, a permanent one, or sole ownership. A veteran who holds the State certificate should rely on it.
