Where it applies

Written for the jurisdictions listed here.

16 GCA § 7120.3 directs the Motor Vehicle Division of the Department of Revenue and Taxation to issue Gold Star licence plates on application. The design is set by the Director and the Office of Veterans Affairs, except that a gold star shall appear on one side of the plate. The last sentence of subsection (a) is the benefit: "The fee for the issuance of gold star license plates is hereby waived." Eligibility under subsection (b) runs to parents, to widows and widowers, and since Public Law 38-140, signed September 1, 2026, to siblings and children of members of the armed services. The parent definition is wider than most: mother, father, stepmother, stepfather, mother through adoption, father through adoption, and foster parents who stood in loco parentis. Siblings include half-siblings and step-siblings, and children include biological, adopted and step-children. The Guam Code Annotated copy the courts serve predates the act and still lists parents and spouses only. The loss must fall in one of three windows. Loss of life during World War I, World War II, or any subsequent period of armed hostilities in which the United States was engaged before July 1, 1958. Loss of life after June 30, 1958 while engaged in an action against an enemy of the United States, while engaged in military operations involving conflict with an opposing foreign force, or while serving with friendly foreign forces engaged in an armed conflict in which the United States is not a belligerent party against an opposing armed force. Or loss of life after March 28, 1973 as a result of an international terrorist attack against the United States or a friendly foreign nation, recognised as such by the Secretary of Defense, or of military operations while serving outside the United States, including the commonwealths, territories and possessions, as part of a peacekeeping force. Two administrative points. Eligibility is certified by the Office of Veterans Affairs on forms prescribed by the Director. And the plates "shall be re-issued only to the original holder," so they do not pass to anyone else. Except for a new or renewed registration, applications are processed in the order received subject to normal workflow, which is the statute telling you that a Gold Star plate application on its own may wait behind registration business. This section does more work than its own subject matter, because two other benefits borrow its eligibility test, but only for some of the people it now covers. The Gold Star property tax exemption at 11 GCA § 24401.2 reaches "a Gold Star spouse or parent(s), who are eligible pursuant to § 7120.3(b)", and the driver licence and vehicle registration fee waivers reach "Gold Star parents who are eligible pursuant to § 7120.3(b)". Both name the relationship as well as the cross-reference, so the siblings and children added in 2026 get the plate and not the property tax exemption or the fee waivers. For a parent or spouse, establishing eligibility here still establishes it for those too.

Amended 16 GCA 7120.3(b) to add siblings, including half- and step-siblings, and children, including adopted and step-children, to the parents, widows and widowers eligible for a free Gold Star plate.
