Delaware Education Benefits for Children of Deceased Veterans, POWs and MIAs
Full tuition and fees for up to four years at a Delaware public college, or a capped amount elsewhere, for a child aged 16 to 24 of a Delaware service member who died from service or was a prisoner of war or missing in action. The child must have lived in Delaware for three years.
Also called: 14 Del. C. 3451, 14 Del. C. 3452, Educational Benefits for Children of Deceased Veterans, war orphans, prisoner of war, missing in action, Delaware Higher Education Office, Department of Education financial aid.
Title 14, sections 3451 to 3455 provide tuition and fees for the children of deceased veterans, prisoners of war and service members missing in action.
The parent. Section 3452, subsection (a) covers the child of a member of the armed forces "who was killed while on active duty or who died from disease, wounds, injuries or disabilities arising or resulting from performance of duty", or who is or was held as a prisoner of war, or who was officially declared missing in action. Section 3451 describes the purpose as benefits for "the children of deceased veterans", so a veteran who died years after discharge from a service-connected condition is covered by the words "died from disease, wounds, injuries or disabilities arising or resulting from performance of duty". Bring the VA decision that service connected the cause of death.
The Delaware link runs through the parent. Subsection (b) requires that the parent was a Delaware resident at the time of death, or is a resident and is or was missing or a prisoner. A family that moved to Delaware after a service member's death does not qualify.
The child. At application the child must be at least 16 and not more than 24, must have been a Delaware resident for at least three years, and must be attending or admitted to a program beyond high school of no more than four years. Section 3453 protects the child if the parent returns alive: a child found qualified is not divested when a prisoner, a missing parent or one mistakenly listed as dead comes home.
What it pays. Section 3455: tuition and fees for up to four years, but it depends on where the child studies. Section 3454 sets an order. The benefit is the full tuition and fees at a Delaware state-supported institution. If the major is not offered there, at a Delaware private institution. If it is offered nowhere in Delaware, at a public or private institution in another state. If the student goes out of that order by choice, the benefit is capped at the average tuition and fees of the Delaware public institutions that offer the major, or of the Delaware private ones if no public institution does. Room, board and books are not covered.
This sits alongside federal Chapter 35 Dependents' Educational Assistance and the Fry Scholarship, which pay separately. Apply through the Delaware Department of Education higher education financial aid portal.
