Vermont / State / 2015-2016 Adjourned Session
2015 Act 121 (Adj. Sess.) Removed the 15-day cap on Vermont military leave and brought State active duty inside USERRA
Struck the 15 days in any calendar year limit from 21 V.S.A. 491 and the separate reinstatement sentence with it, leaving an uncapped right to a leave of absence for drill, training, or other temporary duty under state or federal orders. It also entitled a member ordered to State active duty to the rights and protections of USERRA, which federal law does not reach, and added the 21 V.S.A. 492(c) health insurance continuation under which the State pays the employer’s premium share past 30 days. The federal Army benefits library entry for Vermont still reports the repealed 15-day rule and the repealed reinstatement sentence as current law.
