For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

York County's Commissioner of the Revenue takes the statewide disabled-veteran real estate exemption at any time of year, but only in person, with the VA letter giving the 100% service-connected, permanent, and total rating and its effective date, a Virginia driver's license, and a current utility bill in the veteran's name. A surviving spouse applies the same way with the death certificate and proof of marriage. There is no income test. For the spouse of a service member who died in the line of duty, section 21-7.10 of the County Code, adopted in 2023, created a separate real estate tax class under Code of Virginia section 58.1-3228.2, at a rate set each year. 2024 Acts chapter 583 repealed section 58.1-3228.2 and from January 1, 2025 made such a spouse fully exempt under section 58.1-3219.9, up to the average single-family dwelling value. A spouse should apply for the exemption under section 58.1-3219.9, not the old class.

GateRule
100% permanent and totalYork County applies the statewide exemption to the principal residence, on an in-person application. It states the 100% service-connected, permanent, and total rating. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% pathThe 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Individual unemployabilityThe other path is a total disability rating based on individual unemployability that VA has also rated permanent and total.
Permanent and total on the unemployability pathIndividual unemployability qualifies on this path only when VA has rated the disability permanent and total.
Or a line-of-duty surviving spouse, with no ratingThe surviving spouse of a member of the armed forces who died in the line of duty qualifies under section 58.1-3219.9 without any disability rating.
