What the court says. The statute sets the criteria, but "the final decision to accept a defendant into a program is made by the Prosecutor's Office and the Supervising Judge", and violent offenders are not allowed. The statute itself requires the prosecutor's approval only where the agreement could lead to a dismissal, a delayed or deferred sentence or a guidelines departure, and defines a violent offender narrowly, as an offense involving death, serious bodily injury or criminal sexual conduct. A veteran refused on a broader reading of either should ask the court for its written criteria. The coordinator is John Marra, 313-224-6316, [email protected]. District courts.
