Washoe County's Second Judicial District Court has run a Veterans Treatment Court since 2009 for veterans, Guard members and active-duty members with service-related mental illness, substance use, PTSD or military sexual trauma. It takes misdemeanours from the lower courts and felonies, for a 12-month programme at no charge, and says it targets non-violent defendants.
Also called: veterans court, veterans treatment court, VTC, NRS 176A.280, Second Judicial District Court, Reno, specialty court, Judge Breslow.
Under NRS 176A.280 a district court may run a programme for veterans and service members; see the Nevada entry. The Second Judicial District Court's Veterans Treatment Court, created in 2009, is one of its seven specialty courts, presided over by Judge Barry L. Breslow, with hearings on Tuesdays at 1:30 p.m., also on Zoom.
Who. Veterans of the armed forces and the National Guard, and active-duty members, "who suffer from problems related to military service or readjustment to civilian life". The court says it "targets non-violent, justice-involved veterans suffering from mental illness, alcohol or substance use, post-traumatic stress disorder or military sexual trauma", and participants must be referred to it.
How it works. It is multi-jurisdictional: it takes misdemeanours from the justice and municipal courts and gross misdemeanours and felonies from the district court. Treatment ranges from weekly hearings and check-ins to transitional living and residential programmes, and "Veterans Court operates as a 12-month program at no charge to the veteran".
Where it differs from the statute. NRS 176A.287 bars only a category A felony, a sexual offense punishable as a category B felony, and a dishonorable discharge, which the court can overlook for extraordinary circumstances. The court's "non-violent" target is its own choice, so a veteran charged with another violent offense can still ask to be referred.
