VA Fiduciary Program

When VA decides a beneficiary cannot manage VA payments, it appoints a fiduciary to receive and manage them, and oversees that fiduciary.

Also called: fiduciary, incompetency, payee, VA guardian, competency rating.

For: Veteran or service member.

Where it applies

Applies in states and territories.

VA appoints a fiduciary for a beneficiary who, because of injury, disease or age, VA rates unable to manage their own VA benefits, and for a minor child. The fiduciary is often a family member, and can be a professional or a VA-approved organization. VA checks the fiduciary, requires accountings, and investigates misuse. A beneficiary is told before VA proposes an incompetency rating and can ask for a hearing and present evidence. A rating can be reviewed later, and a beneficiary can ask VA to restore direct payment. A fiduciary who misuses funds can be removed and prosecuted, and VA can reissue misused benefits. A VA fiduciary manages only VA benefits; it is not a court guardianship.
