Tuolumne County Superior Court: Notification of Military Status (TUO-CR-700)

Also called: TUO-CR-700, notification of military status, criminal case, military diversion, 1001.80, 1170.9, 1170.91, restorative relief, Superior Court, MIL-100, Sonora, Jamestown, Columbia, Twain Harte, Tuolumne, Groveland, Mi-Wuk Village, Pinecrest, Soulsbyville, Big Oak Flat, Chinese Camp, Long Barn, Strawberry.

Where it applies

Written for the jurisdictions listed here.

The form. The Superior Court's local criminal form TUO-CR-700, "Notification of Military Status" (revised August 2021 for mandatory use), lets a party, or the party's attorney, declare current or past service in the state or federal armed services or reserves. "I understand that if I submit this form to the court as a defendant in a criminal case, the court will send copies of the form to the County Veterans Service Officer and the Department of Veterans Affairs." File it with the court and serve it on the prosecutor and defence counsel; "You may decline to submit this form to the court without penalty." What it points to. The back of the form: "You are not required to have an honorable discharge, to have combat service, or to be accepted into a Veterans Court to be eligible for the rights described in the following statutes": Penal Code 1170.9 (treatment instead of jail or prison, early end of probation, reduction of some felonies and dismissal after probation, for sexual trauma, brain injury, PTSD, substance abuse or mental health problems caused by service), 1001.80 (pretrial diversion in misdemeanour cases, after which the arrest is deemed never to have occurred) and 1170.91 (service-related conditions as a mitigating factor in felony sentencing). See the California entry on military diversion and sentencing. Filing the form is not itself the 1170.9 assertion or a diversion request; talk to your lawyer. What is out of date. The form prints the Veterans Service Office's old address, 105 Hospital Road (it moved to 950 South Washington Street in September 2026), and cites the Servicemembers Civil Relief Act as "50 App. U.S.C. §§ 501-597(b)", the numbering before its 2015 move to 50 U.S.C. 3901 and following, which the Judicial Council's own form MIL-100 (January 2025) uses. The court has no veterans treatment court; its collaborative courts are a Recovery Court, a Family Treatment Court and CARE Court.
