A 12 to 24 month diversion programme in the 450th District Court for veterans facing misdemeanor or felony charges, which states eligibility by the statute's mental health route only and asks a veteran with a general discharge to explain it.
Also called: veterans court, veterans treatment court, VTC, 450th District Court, diversion, misdemeanor, felony, Government Code 124, Austin.
Travis County runs a veterans treatment court under Government Code chapter 124; see the Texas entry. Judge Brad Urrutia of the 450th District Court presides, and the programme is supported by a grant from the Texas Veterans Commission's Fund for Veterans' Assistance.
What it is. The defence checklist calls it "a 12-24 month diversion program" for veterans facing prosecution on one or more cases, ending in resolution of the case. It takes misdemeanors and felonies: once a veteran meets the basic criteria the application goes to the County Attorney or the District Attorney according to the level of offense, and that office decides whether to accept the case.
Who it takes. The county states eligibility by the statute's first route only: a traumatic brain injury, PTSD or another mental disorder, or military sexual trauma, that occurred during or resulted from service and affected the conduct in the case. Section 124.002(a)(2) also admits a veteran whose participation is likely to achieve public safety through rehabilitation, with no diagnosis needed; the county pages do not mention it. A veteran turned away for lack of a diagnosis should ask the defence lawyer about that route.
Discharge. No discharge is barred, but the application asks for every DD-214 and says a veteran with a general discharge must include "military documentation with explanation of discharge". The statute sets no discharge test.
How to apply. Through the defence lawyer, with the application, all DD-214s, a signed VA release (form 10-5345) and the court's VA screening form completed by the veteran's provider. The application also asks whether the veteran lives in Travis County and about any combat deployment. Send them to the Veterans Treatment Court, 509 W. 11th Street, Suite 3.308, Austin, or call the programme on 512-854-3856.
