Also called: veterans court, veterans treatment court, VTC, diversion, Government Code 124, Belknap.
Tarrant County's criminal courts run a Veterans Treatment Court under Government Code chapter 124; see the Texas entry. The county describes it as an 8 to 24 month diversion programme for justice-involved veterans.
Eligibility follows section 124.002 word for word: a veteran or current member of the armed forces, including the reserves, the National Guard or the State Guard, who either has a service-related brain injury, mental illness or disorder, or military sexual trauma that affected the conduct in the case, or whose participation is likely to achieve public safety through rehabilitation. The case must be pending in Tarrant County. The application asks for the DD-214 or Guard report of separation and offers every discharge characterization, dishonorable included, as an answer, and the county's criteria add no discharge bar.
Conditions. The participant pleads guilty on admission, commits no new offense, avoids alcohol and non-prescribed drugs with random testing, follows treatment and takes prescribed medication, reports to the case manager and attends compliance hearings twice a month. On successful completion the eligible offenses are dismissed.
The court is at 300 W. Belknap, 4th floor, Fort Worth. Ask the defense lawyer to send the referral checklist and application.
