Suffolk Disabled Veteran Real Estate Tax Exemption

Suffolk exempts the home and up to ten acres of a veteran rated 100% service-connected, permanent, and total, through the Department of Social Services. The city code and page still require a surviving spouse to stay in the same home.

Also called: property tax, real estate tax, Suffolk property tax, 100% disabled, ten acres, Social Services.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

In the City of Suffolk the statewide disabled-veteran real estate exemption is filed with the Department of Social Services, under section 82-485 of the City Code, which also runs the city's relief for older and disabled owners. There is no income test. The exemption covers the dwelling and up to ten acres, where the statewide baseline is one acre. Both the city code and the Real Estate Assessor's page still say a surviving spouse qualifies only while he or she "continues to occupy the real property"; the page says the spouse must "continue to live in the same home", and gives the qualifying date of death only as "after January 1" with no year. Since 2019 section 58.1-3219.5(B) has let a surviving spouse of a veteran who died on or after January 1, 2011 move without losing the exemption, and the state statute controls.

GateRule
100% permanent and totalSuffolk applies the statewide exemption to the home and up to ten acres. It states the 100% service-connected, permanent, and total rating. It does not add an income test. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% pathThe 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Individual unemployabilityThe other path is a total disability rating based on individual unemployability that VA has also rated permanent and total.
Permanent and total on the unemployability pathIndividual unemployability qualifies on this path only when VA has rated the disability permanent and total.
