San Luis Obispo County Food Facility Permit Fee Exemption for Veterans
Environmental Health Services waives plan check, consultation and annual food facility permit fees for a veteran who is the sole proprietor of a food business that sells no alcohol, under Business and Professions Code 16102. File the affidavit before paying, because fees already paid are not refunded.
Also called: food permit, health permit, food truck, restaurant, plan check, Environmental Health, 16102, sole proprietor, Brooks v. Santa Clara County.
San Luis Obispo County's Environmental Health Services applies Business and Professions Code section 16102, which lets a veteran with an honorable discharge or a release from active duty under honorable conditions sell goods the veteran owns without paying any licence, tax or fee, to its food programme; see the California entry.
What is waived. The standard food facility plan check fee, the standard plan check consultation fee, and the public health permit to operate a food facility. Fees for expedited plan review or inspections, after-hours inspections, regrades, extra re-inspections and late fees are still charged.
Who. The veteran must be the business's sole proprietor: not an LLC, corporation or partnership, unless every owner is a qualifying veteran. A veteran can claim it for several businesses, each as sole proprietor. A business that sells alcohol cannot claim it. This sole proprietor reading follows section 16102's words, "goods, wares or merchandise owned by him".
How. File the Affidavit for Veteran's Exemption with the permit application, attaching the DD-214, photo ID, and proof of sole ownership such as a business licence, lease or Board of Equalization number. The office decides within five business days.
Two cautions. Fees paid before the exemption is approved are never refunded; an approved exemption starts with the next unpaid billing cycle, so file first. And the affidavit says the DD-214 must show an "honorable discharge", though the statute it quotes also covers a release under honorable conditions, which includes a general discharge.
