Prince George County Line of Duty Surviving Spouse Exemption
Prince George County takes the statewide exemption for the unremarried surviving spouse of a service member who died in the line of duty with a DD Form 1300. Its page quotes a superseded statute: “killed in action”, and a spouse who must keep occupying the home.
Also called: Gold Star spouse, line of duty, killed in action, surviving spouse property tax, KIA, DD 1300.
The Commonwealth exempts the home of the unremarried surviving spouse of a member of the armed forces who died in the line of duty, up to the locality's average assessed value of a single-family dwelling. Prince George's application asks for the Department of Defense DD Form 1300, Report of Casualty, the member's death certificate, a marriage certificate, photo identification, and proof of residency, and asks whether anyone else holds title to the home.
The county's page reprints an old text of section 58.1-3219.9: a member "killed in action", and a spouse who qualifies so long as he or she "does not remarry and continues to occupy the real property". The statute now reads differently on both points. Since January 1, 2025 it covers any member who "died in the line of duty with a Line of Duty determination from the U.S. Department of Defense, including the death of any such member that was the result of suicide", and subsection C says the exemption "applies without any restriction on the spouse's moving to a different principal place of residence". The application likewise says the member "must have been killed in action".
Because Prince George gives five acres in its elderly and disabled program, section 58.1-3219.9(D) requires the same five acres for this exemption.
