Orange County Disabled Veteran Real Estate Tax Exemption
Orange County’s Commissioner of the Revenue takes the statewide home exemption for a veteran rated 100% permanent and total, but asks each applicant for two photo IDs, a Social Security card, and a Virginia license or voter card, and its form borrows a housing-loan definition of “principal residence”.
Also called: property tax, real estate tax, Orange property tax, Gordonsville, Lake of the Woods, 100% disabled, surviving spouse.
Orange County's Commissioner of the Revenue, at 112 West Main Street in Orange, takes the statewide disabled-veteran real estate exemption on its own application, revised February 2024, with the VA letter showing a 100% permanent and total service-connected disability. The letter should show a start date on or before the period the application covers. There is no income test, and the exemption covers the house and up to one acre.
Documents. The page and form ask each applicant for copies of two forms of photo identification, a Social Security card, and proof of residence limited to a Virginia driver's license, a Virginia voter registration card, or a DMV photo ID; all owners must sign. A surviving spouse brings the death certificate, a certified marriage certificate, a utility bill, and a Social Security card. Section 58.1-3219.6 of the Code of Virginia asks only for an affidavit or written statement and the VA documentation. A veteran who does not vote and has a license from another state should ask what else the office will accept.
The form defines "principal residence" by quoting 13VAC10-190-10, a Virginia Housing mortgage-loan regulation about a home "that will be occupied as the primary residence of the purchaser". It is not the test in section 58.1-3219.5, which asks only that the veteran occupy the home as the principal place of residence, and it says nothing about a surviving spouse, who under subsection B keeps the exemption on a new principal residence anywhere in Virginia. The form also asks whether the veteran receives the exemption in another state or Virginia locality, since it is allowed only on the one home that is the principal residence. Neither the page nor the form mentions individual unemployability.

Rule
100% permanent and total
Orange County applies the statewide exemption to the house and up to one acre. It does not add an income test. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% path
The 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Individual unemployability
The other path is a total disability rating based on individual unemployability that VA has also rated permanent and total.
Permanent and total on the unemployability path
Individual unemployability qualifies on this path only when VA has rated the disability permanent and total.
