Orange County Real Estate Tax Relief for Permanent and Total Disability
Orange County relieves 10% to 90% of real estate tax for a permanently and totally disabled owner with household income up to $50,000 and net worth up to $150,000. The code accepts a VA certification of disability; the county’s page lists only doctors and Social Security.
Also called: tax relief, property tax, elderly and disabled, elderly and handicapped, income limit.
Division 3 of Article III of Chapter 58 of the Orange County Code relieves real estate tax on the dwelling of an owner who is 65 or older or permanently and totally disabled. Combined income of the owners, relatives, and other occupants who are not tenants or paid caregivers cannot exceed $50,000, with the first $7,500 of each occupant other than a spouse left out. Net worth cannot exceed $150,000, excluding the home and up to two acres, when the applicant owns alone or with a spouse; with other co-owners, all owners' net worth together cannot exceed $200,000, counting the home, and the relief is prorated by the qualifying owners' share. Relief comes from a table of income and net worth: 90% with income up to $18,750 and the lowest net worth band, falling to 10% at $39,376 to $50,000 of income and the top band. There is no dollar cap. File every year by March 1 with the Commissioner of the Revenue, on paper; emailed copies are not accepted.
Disability proof. Section 58-134 accepts a certification from the Social Security Administration, the Department of Veterans Affairs, or the Railroad Retirement Board, or two doctors' affidavits, as section 58.1-3213(D) requires. The county's page tells applicants under 65 to attach two doctors' affidavits or a Social Security certification and does not mention VA. A disabled veteran can file the VA certification. It is not a VA rating of 100% service-connected, and a disabled veteran who does not meet that test can use it.
