Norfolk Line of Duty Surviving Spouse Exemption

Norfolk takes applications for the surviving spouse exemption under both the old killed-in-action rule and the current line-of-duty rule, and asks line-of-duty applicants for a DD Form 1300 and a Dominion Energy bill.

Also called: Gold Star spouse, line of duty, killed in action, surviving spouse property tax, KIA, DD 1300.

For: Survivor.

Where it applies

Written for the jurisdictions listed here.

Norfolk's Department of Human Services page carries two sections for the same state exemption. The older one, for the spouse of a member "killed in action", dates from the city ordinance effective July 1, 2015 and asks for VA documentation that the Department of Defense found the death was in action. The newer one follows section 58.1-3219.9 as amended from January 1, 2025, for a member the Department of Defense found died in the line of duty. Use the line-of-duty application; it covers deaths in action too. For the line-of-duty route the city asks for the Department of Defense Line of Duty documentation, a DD Form 1300, the marriage certificate, a current Virginia driver's license or ID with the home's address, and a current Dominion Virginia Power bill at the same address. A spouse whose home is not on a Dominion account, or whose service member's paperwork does not include a DD Form 1300, should ask what the office accepts instead; the statute asks only for Department of Defense documentation of the date of death in the line of duty. The exemption is capped at the city's average dwelling value, which the page does not print, and the spouse must not remarry.
