Three statutes, each with its own test.
Children of deceased veterans. Section 28-14-1: tuition-free admission to state secondary and college-grade institutions, plus money for "matricular fees, board and room rent and books and supplies", for children "not under sixteen and not over twenty-six years of age" of a person who was a New Mexico resident on entering the military, served in World War I or II or "during any action in which the military forces of the United States are engaged in armed conflict", and "who were killed in action or died of other cause during the conflict or as a result of such military service". It also covers children of Guard members killed on state active duty after being called by the Governor, and of state police killed on duty. Section 28-14-4 caps the extra money at $300 a year. Section 28-14-3 has the Department of Veterans' Services select children "on the basis of need and merit". The $300 is a 1975 figure and has never been raised.
Children of those killed after a deployment. Section 20-1-8, subsection B: the surviving children of a New Mexico resident Guard or armed forces member killed in the line of duty after being called to active duty and deployed, on or after April 3, 2003 and until the President ends the emergency, are entitled to "waivers of tuition for four consecutive years at a state post-secondary educational institution".
Guard members who die on state duty. Section 20-4-11: the surviving spouse and minor children of a Guard member who dies in the line of duty on state military status get free tuition up to one baccalaureate degree or similar vocational certification at any state institution.
