Where it applies

This is how the City of Newport News applies the statewide disabled-veteran real estate exemption, under section 40-7.06 of the City Code. The Commissioner of the Revenue takes the application with the original VA letter. The land exempted with the home is capped at one acre. There is no income test. The Commissioner's page says individual unemployability qualifies, citing an Attorney General opinion of July 15, 2011 that the exemption covers a veteran paid at the 100% rate on the basis of individual unemployability. The city's certificate of disability, completed by a veterans service officer, has a box for that route. Three local details narrow the statute. First, section 40-7.06(a)(3) says the exemption "shall begin on the date the application is filed". Section 58.1-3219.5(A) says that when the rating comes after January 1, 2011 and the veteran already has the home, the exemption begins on the rating date, with no interest owed on the refund. A veteran who files after the rating date should ask for the refund back to it. Second, the certificate says the veteran's name must be on the deed; the statute also covers a life estate and the trusts it lists. Third, the Commissioner's page still says a surviving spouse must continue to occupy the home, although the city code itself follows the 2019 rule that the spouse may move. A buyer can file with the purchase agreement; the city answers within 20 business days, and the exemption starts on the date of purchase.

GateRule
100% permanent and totalNewport News applies the statewide exemption to the home and up to one acre. It accepts individual unemployability paid at the 100% rate. It does not add an income test. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% pathThe 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Individual unemployabilityThe other path is a total disability rating based on individual unemployability that VA has also rated permanent and total.
Permanent and total on the unemployability pathIndividual unemployability qualifies on this path only when VA has rated the disability permanent and total.
