The Fifth Judicial Circuit's Lake County Veterans Treatment Court takes people arrested in Lake County with a military-related substance use disorder, mental illness, PTSD, military sexual trauma or brain injury, in felony, diversion and sentenced cases. Veterans discharged under any condition, Defense contractors and allied veterans are eligible; the defendant must prove the status.
The Fifth Judicial Circuit runs the Lake County Veterans Treatment Court as a division of the county's courts, under section 394.47891 of the Florida Statutes, the T. Patt Maney Veterans' Treatment Intervention Act; see the Florida entry. Lake County Court Administration runs it, with volunteer veteran mentors, the State Attorney, Public Defender, county and state probation, VA, the Sheriff, the Clerk and the county's Veterans Services.
Who. Someone arrested in Lake County with a mental illness, substance use disorder or other mental health condition related to service, who chooses the court instead of the ordinary process. The court serves "a veteran who is discharged or released under any condition", service members as section 250.01 defines them, current and former Defense Department contractors, and current and former members of an allied country's military, with a military-related substance use disorder, mental disorder including PTSD and military sexual trauma, or traumatic brain injury. The defendant carries the burden of proving that status, for example with a DD-214.
Ways in. It is a hybrid court taking felony cases, pretrial diversion cases and cases already sentenced. A violation of probation case can be transferred with the sentencing judge's approval, and a sentence can be modified into the programme under rule 3.800(c) with the sentencing judge, the State Attorney and the defendant agreeing. The circuit publishes the application, a guide for defendants and a guide for lawyers.
