Where it applies

Written for the jurisdictions listed here.

Division 3 of article II of chapter 70 of the county code (as amended by Ordinance No. 10-23, November 27, 2023) sets the program for "real estate and mobile homes... owned by and occupied as the sole dwelling of a head of household not less than 65 years of age or who is determined to be permanently and totally disabled". Total combined income falls in the exemption bands of section 70-103(c)(1), and net combined financial worth must be less than $125,000 "excluding the value of the dwelling and the land, not exceeding five acres upon which it is situated". The scale: 100 percent of the tax where total combined income is less than $35,000, 75 percent from $35,000 to $45,000, and 50 percent from $45,000 to $55,000 - and "in no case shall the total annual exemption exceed $1,000.00". The claimant files a full affidavit every three years and an annual certification in between (section 70-104); an under-65 applicant attaches a certification from the Social Security Administration, the Department of Veterans Affairs or the Railroad Retirement Board, or two doctors' affidavits with one based on a physical examination. First-time applicants and hardship cases may file through June 30, with the exemption applied against the second half and "in no case exceeding $500.00" (section 70-104.1). It is not a VA rating of 100% service-connected, and a disabled veteran who does not meet that test can use it.
