The 16th Judicial Circuit runs the Kane County Veterans Treatment Court under 730 ILCS 167; see the Illinois entry. It began in 2018 and sits at the Kane County Judicial Center, 37W777 Route 38, St. Charles. Its team includes the judge, the State's Attorney, the Public Defender, Court Services, Hines VA Hospital, the Veterans Assistance Commission and a mentor coordinator; it now has a low-risk track as well. Who (Court Services' criteria). Kane County residence; a veteran, meaning someone who served on active duty and was discharged "under conditions other than dishonorable", or a current service member, Guard and reserves included; a non-violent offender; a guilty plea to the current charges; a verified mental illness or substance use disorder; and willingness to take part. Where it narrows the Act. Section 10 of the Veterans and Servicemembers Court Treatment Act defines a veteran as anyone who previously served as an active servicemember, with no discharge test. Section 20(a-5) lets each court set its own written criteria, so the discharge rule is the court's choice, but a veteran with a dishonorable discharge should ask defence counsel whether it can be waived. Referrals come from the judge, the State's Attorney, the Public Defender, a private attorney or the Diagnostic Center, on a referral sheet to the programme coordinator.
