Hampton Line of Duty Surviving Spouse Exemption

Hampton caps the line-of-duty surviving spouse exemption by comparing only the dwelling, not the land, against the city average single-family dwelling value. Its page still requires the spouse to stay in the same home.

Also called: Gold Star spouse, line of duty, killed in action, surviving spouse property tax.

For: Survivor.

Where it applies

Written for the jurisdictions listed here.

Hampton's page describes the exemption for the surviving spouse of a member of the armed forces who died in the line of duty, as determined by the Department of Defense. The spouse needs an original Department of Defense letter verifying the member's service and line-of-duty death, applies in person, and does not reapply unless the principal residence changes. Hampton measures the cap on the dwelling alone. "Dwellings (the home excluding the land)" at or under the city's average assessed value for dwellings on land zoned single-family residential are exempt, and above it only the excess is taxable. A life estate and the trusts the statute lists qualify, and a home co-owned with someone who is not eligible is prorated. The city does not print its average figure. The page says the spouse qualifies while he or she "continues to occupy the property". Section 58.1-3219.9(C) lets the spouse move to another principal residence without losing the exemption.
