Hampton Disabled Veteran Real Estate Tax Exemption

Hampton applies the statewide exemption for a veteran rated 100% service-connected, permanent, and total, or paid at 100% for individual unemployability, by in-person appointment with original VA documents. The page contradicts itself on whether a surviving spouse may move.

Also called: property tax, real estate tax, Hampton property tax, 100% disabled, TDIU.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

This is how the City of Hampton applies the statewide disabled-veteran real estate exemption. The Commissioner of the Revenue takes the application in person, by appointment. There is no income test, and the veteran does not reapply unless the principal residence changes, though the office may ask for documents to reaffirm eligibility and must be told of changes in residence, disability status, ownership, or marital status. Hampton names the individual unemployability route: an overall rating of 100%, or payment at the 100% rate for individual unemployability, with VA finding the veteran permanently and totally disabled and no further examinations required. The VA documents have to be originals, not photocopies or faxes, and must give the effective dates of the 100% or unemployability rating and of the permanent and total finding. The page states the surviving spouse rule twice. One sentence says the spouse must continue "to occupy the real property as principal place of residence"; the next leaves that condition out. Section 58.1-3219.5(B) has let the spouse move without losing the exemption since 2019, so the second sentence is the right one.

Thresholds

Thresholds for Hampton Disabled Veteran Real Estate Tax Exemption
GateRule
100% permanent and totalHampton applies the statewide exemption to the principal residence. It accepts payment at the 100% rate for individual unemployability with a permanent and total finding. It does not add an income test. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% pathThe 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Individual unemployabilityThe other path is a total disability rating based on individual unemployability that VA has also rated permanent and total.
Permanent and total on the unemployability pathIndividual unemployability qualifies on this path only when VA has rated the disability permanent and total.
