Greene County Clerk: the Fee Schedule’s Discharge Lines Are Lien Discharges - Military Law 250 Carries the Free Recording (Marilyn Farrell)

The Greene County Clerk - Marilyn Farrell, Deputy Amy Katt, 411 Main Street, Suite 202, Catskill (518-719-3255, fax 518-719-3284), Monday to Friday 9:00 to 4:45 - files veterans' DD-214s; the office's own fee schedule carries no military-discharge line (its 'Discharge' rows are bail-bond and bond-undertaking lien discharges at 1.00 and 5.00 dollars), so the free recording and certified copies are Military Law 250, carried by the State entry.

Where it applies

The office. Greene County Clerk Marilyn Farrell, 411 Main Street, Suite 202, Catskill NY 12414; 518-719-3255, fax 518-719-3284, [email protected]; hours Monday to Friday 9:00 a.m. to 4:45 p.m.; Deputy County Clerk Amy Katt. The page: "The Clerk of Greene County is responsible for the recording, filing, storage and upkeep of a variety of documents. These include deeds, mortgages, criminal records and all court records for the Supreme Court and County Court. The County Clerk also supervises the Department of Motor Vehicles and the Records Center." Records search online through SearchIQS (searchiqs.com/nygre); the Records Center itself - "over 30 County departments and agencies, housing over 12,000 cubic feet of inactive County records" - sits at 465 Main Street, Catskill under Records Management Director Erin O'Brien (518-943-2472) and does NOT provide public access. The missing line. The Clerk's Schedule of Fees (FeeSchedule9-10.pdf) prints, under Bail Bond Lien, the rows "If Filed by D.A. - No Fee", "If filed by individual - $5.00", "Discharge - $1.00" and "Certificate of Discharge - $1.00", and under Bond & Undertakings a "Discharge - $5.00". Those "Discharge" rows are the fees for discharging a bail-bond lien or an undertaking from the index, not the filing of a veteran's discharge certificate: the schedule carries no military-discharge line at all. New York's Military Law 250 requires every county clerk to record an honorable discharge or certificate of service "without the payment of any fee" and to furnish certified copies free to the veteran or a parent, spouse, dependent or child (the State entry, which also carries the record's closure to the public). A veteran quoted the 1.00 dollar line cites Military Law 250. The appointment route. The Clerk's online booking and in-person counter handle the filing; the Veteran's Service Agency (300 Route 23B, Leeds, 518-943-3703) helps veterans assemble the DD-214 copy first.
