Franklin County Disabled Veteran Real Estate and Vehicle Tax Exemptions, Five Acres

Franklin County takes the statewide home and one-vehicle exemptions for a veteran rated 100% service-connected, permanent, and total. Because its elderly program covers five acres, state law gives the veteran five acres too, which the county’s page does not say. It asks for a voter registration card as proof of residence.

Also called: property tax, real estate tax, Rocky Mount, Smith Mountain Lake, car tax, 100% disabled, five acres.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

Franklin County's Commissioner of the Revenue, in Rocky Mount, takes the statewide disabled-veteran real estate exemption and the one-vehicle exemption on one application, with the original VA letter showing a disability that is 100% service-connected, permanent, and total. There is no income test. The page and form state the surviving spouse and vehicle rules as the statutes do, including a car owned only by the spouse and used for the veteran. The page adds that a vehicle owned by any trust does not qualify, which section 58.1-3668 does not address. Acreage. Section 20-18 of the county code gives the elderly and disabled exemption on the dwelling and up to five acres. Section 58.1-3219.5(C) of the Code of Virginia then requires the county to "provide an exemption for the same number of acres" to the disabled veteran, so the veteran's exemption covers five acres, not one. The county's page and form do not mention acreage; a veteran with more than one acre should check the bill and cite subsection C. The same rule carries five acres to a line-of-duty surviving spouse under section 58.1-3219.9(D). The page asks the veteran, and a surviving spouse, to bring a voter registration card as "proof of residence of occupancy". Section 58.1-3219.6 asks only for the application and the VA documentation, and the form itself says only "photo ID and proof of residency"; a veteran who does not vote can show residence another way. Franklin County has no separate rate for the limb loss and blindness class in section 58.1-3506(A)(19); its personal property rate is $2.41 per $100.
