Forsyth County Tax Administration: Disabled Veteran Exclusion

How Forsyth County describes the State's $45,000 disabled veteran homestead exclusion: form AV-9 by June 1, for an "honorably discharged" veteran with a 100% permanent and total rating or an adapted housing grant. The page leaves out the surviving spouse's route through a service-connected death and the State's NCDVA-9 certification, and Forsyth has no county veterans office to certify it.

Also called: property tax, homestead exclusion, disabled veteran's exclusion, 105-277.1C, AV-9, NCDVA-9, $45,000, June 1, surviving spouse, Winston-Salem.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

The exclusion is the State's, under G.S. 105-277.1C; see the North Carolina entry. Forsyth County Tax Administration decides claims (336-703-2300). What the county says. $45,000 of the appraised value of a permanent residence owned and occupied by "an honorably discharged disabled veteran or the unmarried surviving spouse of an honorably discharged disabled veteran" is excluded. A disabled veteran is one who "has 100% permanent total disability that is service-connected" or receives benefits for specially adapted housing under 38 U.S.C. 2101. Apply on the State's form AV-9 by June 1. Where the page is narrower than the statute. Discharge. The statute asks for a character of service at separation that was honorable or under honorable conditions, so a general discharge under honorable conditions qualifies, not only an honorable one. Surviving spouses. The page defines the spouse's eligibility by the veteran's rating or grant. The statute also counts a deceased veteran whose death VA has certified as the result of a service-connected condition, with no rating needed in life. A surviving spouse on Dependency and Indemnity Compensation should apply with that VA letter. The certification. The page asks only for the AV-9 "for certification by the US Department of Veterans Affairs". The State's process uses its own form NCDVA-9, certified by a veterans service officer, filed with the AV-9; a VA letter showing the permanent and total rating or the 2101 grant is the evidence G.S. 105-277.1C(f) asks for. Forsyth has had no county veterans office since the mid-1980s, by its own budget office's account, so ask an accredited service officer, such as one of the service organisations at VA's Winston-Salem Regional Office, 251 North Main Street, to certify the NCDVA-9, or ask Tax Administration what it will accept. Late filing. The page gives only June 1, but G.S. 105-282.1(a1) lets the county accept a late application for good cause, for that year only. A home with this exclusion cannot also have the elderly or disabled exclusion or the circuit breaker.

Thresholds

Thresholds for Forsyth County Tax Administration: Disabled Veteran Exclusion
GateRule
Permanent and total service-connected disabilityThe rating path is VA's certification of a permanent and total service-connected disability, as of January 1. A section 2101 adapted housing grant qualifies instead, and an unremarried surviving spouse qualifies on any of the veteran's routes or a service-connected death; the rating filter cannot test those.
Discharge honorable or under honorable conditionsThe statute takes honorable or under honorable conditions. The county page says "honorably discharged"; a general discharge under honorable conditions still meets the statute.
