Florida Personal Income Tax

Florida does not levy a personal income tax on natural persons. Military retirement pay, VA compensation, and other personal income are not taxed by the state.

Also called: income tax, military retirement, retired pay, no state income tax.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

Article VII, section 5(a) of the Florida Constitution bars a tax on the income of natural persons who are residents or citizens of the state, beyond the aggregate that can be credited against a similar federal or other state income tax. Florida does not levy a personal income tax. Chapter 220 imposes an income tax on corporations and certain other artificial entities. Section 220.02 says that tax is not to be construed to tax a natural person, and it points back to the same constitutional section. Military retirement pay, VA disability compensation, and other personal income are therefore not taxed by Florida. There is no retirement subtraction to claim, because there is no personal return. The corporate income tax is a different tax and does not change this.
