Florida Driver License Fee Waiver for a 100% Permanent and Total Disability

No driver-license fee under section 322.21 for an honorably discharged veteran with a 100% total and permanent service-connected rating, or a department identification card issued for that status.

Also called: driver license, identification card, FLHSMV, 100%, permanent and total, Veteran designation.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

Section 322.21(7) exempts a veteran from all fees in that section when the veteran was honorably discharged and is qualified for a Florida driver license, and any one of these is true: the Department of Veterans Affairs has issued an identification card under section 295.17, VA has determined a 100% total and permanent service-connected disability rating for compensation, or the veteran has a service-connected total and permanent disability rating of 100% and is receiving disability retirement pay. Highway Safety and Motor Vehicles tells the veteran to bring a VA identification card showing the 100% total and permanent service-connected rating. The waiver covers the license, endorsements, and an identification card for that veteran. A separate, narrower rule puts the word Veteran on a driver license or identification card. If the only change is adding that word, the replacement card is issued without the usual replacement fee. That designation is available from a DD-214 or another form the department accepts. It is not this fee waiver, and it does not require a disability rating. The plate in section 320.084 can be issued on a 100% rating that is not permanent. This fee waiver asks for total and permanent.

GateRule
100% total and permanentThe fee waiver requires a 100% total and permanent service-connected rating, the department identification card issued for that status, or a 100% total and permanent rating plus disability retirement pay. Honorable discharge is also required.
Permanent and totalThe 100% rating has to be total and permanent. A 100% rating VA has not made permanent does not meet the statute.
