Death & Survivor Benefits

Erie County Burial Allowance and Headstones

Erie County pays the statutory minimum of $75 toward the burial of a wartime veteran or a war veteran's spouse, and up to $100 toward a headstone, bronze tablet, lettering or base for a government headstone on a grave that has never had a memorial. Its headstone form still cites the General County Code of 1929, and the $100 cap is the county's, not the statute's.

Also called: burial allowance, $75, funeral, headstone, bronze tablet, grave marker, spouse burial, 16 Pa.C.S. 15509, 15513, County Code of 1929.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

The duties are the State's, under 16 Pa.C.S. Chapter 155; see the Pennsylvania entry on county burial and grave benefits. The Department of Veteran Services certifies the applications. Burial allowance. The county's "Application for Burial Allowance, War Veteran or Spouse of War Veteran" pays $75, the minimum sections 15509 and 15510 allow, to the applicant named on the form. Attach a certified copy of the discharge, a certified death certificate and the funeral bill; the funeral director certifies the expenses. Apply within one year of the death. Headstones. The headstone application pays up to $100 toward a headstone, a bronze memorial tablet, lettering on an existing memorial or a base for a government headstone, on a grave where "there has never been a memorial", for a veteran who lived in Erie County at death, with the contractor's certificate of erection. Section 15513 makes the base for a federal headstone, or the lettering on an existing family memorial, an actual-cost duty approved before the work starts; the $100 ceiling and the never-had-a-memorial condition are not in it, so ask the office before paying a larger bill. Out-of-date citations. The headstone form says it is made "under Section E26 of the General County code of 1929". The 1929 Code was replaced by the County Code of 1955 and that by 16 Pa.C.S. in 2024 (Act 14); the provisions are now sections 15508 to 15516.
