The Clerk's own form. The Clerk of Superior & State Courts' "Military Discharge Records" item links an "Affidavit to View or Copy Military Discharge Records" PDF. The affidavit's requester certifies under penalty of law to being "the person who is the subject of the record; the spouse or next of kin of the person who is the subject of the record; a person named in an appropriate power of attorney executed by the person who is the subject of the record; the administrator, executor, guardian, or legal representative of the person who is the subject of the record; or an attorney for any person specified" - the Code section 15-6-72 classes - and acknowledges that records obtained "shall not be reproduced or used in whole or in part for any commercial or speculative purposes", that dissemination outside the statute is barred, and that "violation of this subsection shall constitute a misdemeanor and shall be punished by a fine not to exceed $5,000.00". The affidavit's identifying block asks the record subject's name, date of birth, Social Security number and approximate discharge date. The State rule carries the rest: the clerk records a DD-214 or other discharge certificate free (section 15-6-78(a), 15-6-77(i)), the record stays exempt from the Open Records Act for 50 years, and certified copies to the listed parties are free. The Clerk's office is in the Athens-Clarke County Courthouse, 325 East Washington Street, Athens; the recording window and the clerk's name are the office's own pages to confirm.
