Chesapeake Real Estate Tax Relief for Permanent and Total Disability

Income-based real estate relief for a Chesapeake owner who is permanently and totally disabled, with household income up to $70,000 and net worth up to $350,000. Disability income counts, apart from the first $10,000.

Also called: tax relief, property tax, elderly and disabled, income limit, permanently and totally disabled.

For: Veteran or service member.

Where it applies

Written for the jurisdictions listed here.

Chesapeake's real estate tax relief, under section 30-104 of the City Code, is for an owner who is 65 or older, or permanently and totally disabled at any age. VA, the Railroad Retirement Board, or Social Security can certify the disability; otherwise two Virginia physicians' sworn affidavits, one based on an examination, are needed. It is not a VA rating of 100% service-connected, and a disabled veteran who does not meet that test can use this program. Combined household income for the prior calendar year cannot exceed $70,000, excluding the first $10,000 of income of an owner certified permanently disabled and of each relative other than a spouse. The Commissioner lists disability income among the income that counts, so VA compensation above that exclusion is counted. Net worth cannot exceed $350,000, excluding the home and up to three acres. Relief is 100% up to $25,000, 75% to $36,000, 50% to $53,000, and 25% to $70,000. Relief is annual. Apply by appointment between January 1 and May 15 each year.
